This Privacy Policy explains how information about you is collected, used, and shared by Swopity LLC. (hereafter “Swopity”, “our “,”we” or “us”). This Privacy Policy applies to information we collect when you use our website, mobile applications, when you interact with us, and when you use other online services (collectively, the “Swopity Service’).

We may change this Privacy Policy from time to time. If we make changes, we will notify you by revising the date at the top of this Privacy Policy and, in some cases, we may provide you with more prominent notice (such as adding a statement to our homepage or sending you an email notification). We encourage you to review the Privacy Policy whenever you access the Swopity Service to stay informed about our information practices and the ways you can help protect your

privacy.

1. Information We Collect and How We Collect It.

1. Information You Provide to Us.

1. Swopity collects information that you provide directly to us when you sign up and use the Swopity service including:

a. Information when you register or update the details of your account,

b. Post items for sale,

c. Enroll in third-party payment processing services offered in connection with the Swopity Service.

d. Communicate with other users, provide reviews or other comments, purchase services from Swopity.

e. Request customer support, or otherwise communicate with us.

2. The types of information we may collect include:

1. your name,
2. email address,
3. Swopity account password (encrypted),
4. telephone number,
5. postal address including city, state, and zip code,
6. photographs of posted items,
7. written descriptions of your posted items,
8. bids you make on items,
9. reviews or comments you make on the Swopity Service,
10. all messages with other users or with us sent through the Swopity messaging service or to Swopity directly,
11. government issued identification documents (such as a driver’s license),
12. any other information you choose to provide.

2. Information We Collect Automatically

When you access or use the Swopity Service, we automatically collect information about

you, including:

1. We log information about your use of the Swopity Service, including the type of browser you use, access times, pages viewed, your IP address, and the page you visited before navigating to our Swopity Service.

2. We collect information about the computer or mobile device you use to access the Swopity Service, including the hardware model, operating system and version, unique device identifiers, and mobile network information.

3. If you consent to the collection of location information from your computer or mobile device, we may collect this information when you access the Swopity Service or when you otherwise consent to the collection of this information. We may also use your IP

address to infer an approximate geographic location for your computer or device.

4. We use various technologies to collect some of the information listed above, and this may include sending cookies to your computer or mobile device. Cookies are small data files stored on your hard drive or in device memory that helps us to improve the Swopity Service and your experience, see which areas and features of the Swopity Service are popular and count visits. We may also collect information using web pixels (also known as “gifs? “pixel tags” and “tracking pixels”). Web tracking pixels that may be used in the Swopity Service or emails and help deliver cookies, count visits, understand usage, advertising campaign effectiveness, and determine whether an email has been opened and acted upon.

3. Information from Third Parties.

Swopity may, from time to time, obtain information from other sources and combine that with information we collect through the Swopity Service in order to enhance our ability to serve you, prevent fraudulent transactions, tailor our content to you, deliver relevant advertising to you, offer you opportunities to purchase products or services that we believe may be of interest to you, and for any other purposes described in this Privacy Policy. For example,if you create or log into your account through a social media site,we will have access to certain information from that site, such as your name, account information and friends lists, in accordance with the authorization procedures determined by such social media sites. We may also receive transaction information from Payment Gateways used by Swopity Service. when you swap, purchase or sell items using the Swopity payment solution, including the date and time of sale and the amount the sale.

2. How We Use Your Information.

Swopity uses information about you for various purposes, including to:

1. Verify your login information to allow you to access and use the Swopity Service, to personalize the Swopity Service, and to optimize the location and type of offers presented to you when you use the Swopity Service;

2. Connect you to other users on the Swopity Service via friends lists when authorized by you.

3. Create and maintain a trusted and safer environment on the Swopity Service, including through detection and prevention of fraud, unauthorized access, intrusion, and service interruption.

4.Conduct investigations and to respond to disputes between users, error resolution, and other similar customer support service.

5. Enable any identification programs we may institute and in which you elect or are required to participate, such as verifying your identity and address, and conduct checks against various publicly available databases.

6. Operate, protect, improve and optimize the Swopity Service, our business, and our user’s experience;

7. Perform analytics, conduct research, and monitor and analyze trends, usage and activities in connection with the Swopity Service;

8. Communicate with you about products, services, offers, promotions, rewards, and events offered by Swopity and others.

9. Provide advertisements, news, and information to match user profiles or interests that we think will be of interest to you.

10. Send you service, support and administrative messages, reminders, technical notices, updates, security alerts, and information requested by you.

11. Comply with our legal obligations or requests from law enforcement agencies, resolve any disputes that we may have with any of our users, and enforce our agreements with third parties.

12. Link or combine with information we get from others to help understand your needs and provide you with better service.

13. Assist third-party payment processors with transaction processing, error, chargeback and disputed transaction resolution, and similar payment processing functions.

3. Why We May Share Your Information and When.

A. We may share the information we collect about you in the following situations:

1. With the public when you post on the Swopity Service. For a detailed description of the type of information associated with your Swopity account that is made available publicly through the Swopity Service.

2. When you register through the Swopity Service to receive electronic payments via payment services, we will share certain information about you with payment service, including name, address, IP address as directed by you to sign up for payment services. This information is in addition to the information collected directly by the payment solution. Payment solution may use this information for the purposes described in its privacy policy, including for fraud prevention.

3. With vendors, consultants, and other service providers who need access to such information to carry out work on our behalf (including, without limitation, with third-party service providers that may use the information we share to help us and other companies detect inaccurate personal information and prevent fraudulent transactions).

4.With advertisers to help us deliver relevant advertising to you on the Swopity Service and across the internet.

5. In response to a request for information if we believe disclosure is in accordance with any applicable law, regulation, or legal processor, as otherwise required by any applicable law, rule, or regulation.

6. If we believe your actions are inconsistent with the spirit or language of our user agreements or policies or to protect the rights, property, and safety of Swopity or others.

7. In connection with, or  during negotiations of, any merger, sale of company assets, financing or acquisition of all or a portion of our business to another company.

8. Between and among Swopity, and its current and future parents, affiliates, subsidiaries, and other companies under common control and ownership.

9. With your consent or at your direction, including as mentioned in the Social Sharing Features section below or if we otherwise notify you through the Swopity Service that the information you provide will be shared in a particular manner and you provide such Information.

10. We may also share aggregated or de-identified information, which cannot reasonably be used to identify you.

B. When You Choose to Share Outside of Swopity

The Swopity Service offers social sharing features and other integrated tools (such as the Facebook “Like” button), which let you share actions you take on the Swopity Service with other media, and vice versa. The use of such features enables you to share your information with your friends or the public, depending on your selected settings on those platforms.

C. Advertising and Analytics Services Provided by Others

1. We may allow partners like Google and Facebook to serve advertisements on the Swopity Service, on our behalf across the Internet, and to provide us with analytics services. These entities may use cookies, web beacons, and other technologies to collect information about your use of the Swopity Service and other websites and online services, including your IP address, device identifier, web browser, pages viewed, time spent on pages, links clicked and conversion information.

2. Information collected by these service providers may be used by Swopity and others to, among other things, analyze and track data, determine the popularity of certain content, deliver advertising and content targeted to your interests on the Swopity Service and other websites and online services, and better understand your online activity.

4. Your mobile device operating system may also include a feature that allows you to opt out of having certain information collected through apps used for behavioral advertising purposes.

D. Security

1. Swopity takes reasonable measures to help protect information about you from loss, theft, misuse and unauthorized access, disclosure, alteration, and destruction.

2. Swopity protects your privacy by limiting the amount of personally identifiable data we share with third parties. In most cases, we share data that is aggregated or anonymized. When we do need to share identifiable data with third parties, we take steps to ensure that they provide the same level of protection to your data as Swopity provides under this Privacy Policy.

4. Your Choices

A. Account Information.

1. You may update, correct, or remove account profile information at any time by logging into your account.

2. You can deactivate your account. We will make your account inactive until the time you decide you would like to return to using the Swopity Service. To reactivate your account, you can sign in using the same username and password.

3. If you are on an iOS device and would like to delete your account, you can request deletion from your Account Settings menu.

4. Please note that we may retain certain information as required by law or for legitimate business purposes. We will also retain certain information such as reviews, forum postings, and similar materials posted by you may continue to be publicly available (but not associated with your identifiable information) on the Swopity Service after your Swopity account is canceled.

B. Location Information.

1. When you first download our mobile app or the first time you attempt to use any features that use location information, you will be asked to consent to our collection of this information. You may revoke your consent to our tracking location information at any time by changing your preferences in the settings menu on your mobile device or by following the standard uninstall process to remove our mobile application from your device.

2. Even if you do not consent to collect the precise location from your mobile device, we may use your IP address to infer an approximation of your location when using certain features of the Swopity Services, such as the Swopity payments solution.

3.In some features, Swopity uses mapping services from Mapbox or Google Maps/Google Earth, including Google Maps API(s). Your use of these services is subject to Mapbox terms of service and Google terms of service.

C. Cookies.

Most web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove or reject browser cookies. Removing or rejecting browser cookies does not necessarily affect third-party flash cookies used in connection with the Swopity Service. Please note that removing or rejecting certain cookies may affect the functionality of the Swopity Service.

D. Promotional Communications

You may opt out of receiving promotional emails, text messages, and other communications from Swopity by following the instructions in those emails, text or other communications or by making changes in your Swopity account Settings menu.
